Article 221. Legislative Powers of Local Level
- (1)Subject to this Constitution, the legislative powers of the Local Level shall be vested in the Rural Municipal Assembly and the Municipal Assembly.
- (2)The legislative powers of the Rural Municipal Assembly and the
Municipal Assembly shall be as enumerated in the lists contained in Schedule-8 and Schedule-9.
Article 222. Composition of Rural Municipal Assembly
- (1)There shall be a Rural Municipal Assembly in each Rural Municipality.
- (2)A Rural Municipal Assembly referred to in clause (1) shall consist of the
Chairperson and Vice-Chairperson of the Rural Municipal Executive, Ward Chairpersons, and four members elected from each ward and Members of the Rural Municipal Executive elected from Dalit and minority communities pursuant to clause
- (4)of Article 215.
- (3)A Rural Municipal Assembly to be formed pursuant to clause (1) shall have representation of at least two women from each ward.
- (4)Each ward of a Rural Municipality shall have a Ward Committee composed of the Ward Chairperson and four members in accordance with the federal law. Such Ward Chairperson and Ward members shall be elected in accordance with the first past the post electoral system.
- (5)Every person who has completed the age of eighteen years and whose name is included in the electoral rolls of the Rural Municipality shall have a right to vote as provided for in the federal law.
- (6)A person who has the following qualifications shall be eligible to become a candidate for the office of the Member of the Rural Municipal Assembly:-
- (a)One who is a citizen of Nepal;
- (b)One who has completed the age of twenty-one years; www.lawcommission.gov.np
- (c)One whose name is included as a voter in the electoral rolls of the Rural Municipality; and
- (d)One who is not disqualified by any law.
- (7)Matters relating to the election to the Rural Municipal Assembly and other matters pertaining thereto shall be as provided for in the federal law.
Article 223. Composition of Municipal Assembly
- (1)Each Municipality shall have a Municipal Assembly.
- (2)A Municipal Assembly referred to in clause (1) shall consist of the Mayor and the Deputy Mayor of the Municipal Executive, Ward Chairpersons, and four members elected from each Ward and members of the Municipal Executive elected from Dalit or minority communities pursuant to clause (4) of Article 216.
- (3)A Municipal Assembly to be formed pursuant to (1) shall have representation of at least two women from each Ward.
- (4)Each ward of a Municipality shall have a Ward Committee composed of one Ward Chairperson and four members as provided for in the federal law. Such
Ward Chairperson and Ward members shall be elected in accordance with the first past the post electoral system.
- (5)Every person who has completed the age of eighteen years and whose name is included in the electoral rolls of the Municipality shall have a right to vote as provided for in federal law.
- (6)A person who has the following qualifications shall be qualified to be a candidate for the office of member of the Municipal Assembly:-
- (a)One who is a citizen of Nepal;
- (b)One who has completed the age of twenty-one years;
- (c)One whose name included in the electoral rolls of the Municipality; and
- (d)One who is not disqualified by any law.
- (7)Matters relating to the election to the Municipal Assembly and other matters pertaining thereto shall be as provided for in the federal law.
